Hello!
If you have found your way here, it is a sure sign that you value your privacy. We understand this perfectly, which is why we are handing you a document in which you will find, in one place, the rules for processing personal data and for using cookies and other tracking technologies in connection with the operation of the website https://jakubjacek.pro
A formal note to start with – the website is administered by Jakub Jacek, who conducts business activity through Moonwise Spółka z ograniczoną odpowiedzialnością with its registered office in Gdańsk, at Al. If you have any questions about your personal data, we are at your disposal at RODO@jakubjacek.pro.
# 6: For what purposes do we process your personal data?
There is more than one purpose. Below you will find a list of them, followed by a more detailed discussion. We have also assigned the appropriate legal bases for processing to the individual purposes.

- handling complaints or withdrawals from a contract – Article 6(1)(f) GDPR,
- sending the newsletter – Article 6(1)(a) GDPR,

- fulfilment of tax and accounting obligations – Article 6(1)(c) GDPR,
- creating an archive for the possible need to defend, establish or pursue claims, and to identify returning customers – Article 6(1)(f) GDPR,
- marketing of our own products – Article 6(1)(f) GDPR,
- analysis, statistics and optimisation – Article 6(1)(f) GDPR.
- ensuring the functioning of the YouTube and SoundCloud players, Facebook widgets, Disqus comments and MailerLite newsletter forms using Anonymous Information only – Article 6(1)(f) GDPR.
User account – details
When creating a user account, you must provide the data necessary to create it: your e-mail address and a password. Providing the data is voluntary but necessary to create an account.
When editing your account data, you may provide further data, in particular data that may be used when placing orders, such as your first name and surname, residential or business address, tax identification number (NIP) and telephone number.
If you create an account through integration with a social media account, on the basis of your prior authorisation we will gain access to certain data collected in your social media account (first name and surname, e-mail address, profile picture).
We analyse such information about you in order to optimise our websites in terms of user experience, effectiveness and conversion, which constitutes our legitimate interest referred to in Article 6(1)(f) GDPR.
You can modify the information about you provided to us in connection with registering a user account at any time. However, if you created your account using integration with a social media account, the data retrieved from that social network can only be modified or deleted through that service.
The data you provide in connection with creating an account are processed in order to provide you with an electronic service consisting in enabling you to use a user account. This service is provided under a contract concluded on the terms described in the Terms and Conditions, which means that the legal basis for processing your personal data in this respect is Article 6(1)(b) GDPR.
The data will be stored for as long as the user account exists. You can decide to delete your account at any time; however, this will not result in the deletion from our database of information about orders you placed using the account. Order data are stored in our archive for the entire period of the website’s operation in order to enable us to identify returning customers and reconstruct their purchase history, discounts granted, etc., which constitutes our legitimate interest referred to in Article 6(1)(f) GDPR.
Newsletter – details
When subscribing to the newsletter, you provide us with your first name and e-mail address. Providing the data is voluntary but necessary to subscribe to the newsletter.
In addition, the system we use to run the newsletter records the IP address you used when subscribing, determines your approximate location and the e-mail client you use, and tracks your actions in relation to the messages sent to you. As a result, we also have information on which messages you opened, in which messages you clicked links, etc.
The data you provide to us in connection with subscribing to the newsletter are used to send you the newsletter, and the legal basis for their processing is your consent (Article 6(1)(a) GDPR) given when subscribing. As regards the processing of information that does not come from you but has been collected automatically by our mailing system, we rely on our legitimate interest (Article 6(1)(f) GDPR) consisting in analysing the behaviour of newsletter subscribers in order to optimise our mailing activities.
You can unsubscribe from the newsletter at any time by clicking the dedicated link in every newsletter message or simply by contacting us. Even after you unsubscribe, your data will continue to be stored in our database in order to identify returning subscribers and to defend against possible claims related to sending you the newsletter, in particular to demonstrate that you gave consent to receive the newsletter and when you withdrew it, which constitutes our legitimate interest referred to in Article 6(1)(f) GDPR.
You can modify the data you provided for the purpose of receiving the newsletter at any time by clicking the relevant link visible in every newsletter message or simply by contacting us.
Comments and product reviews – details
When adding a comment or a product review, you must provide at least a user name, which will be assigned to the comment or review (the name may contain personal data, e.g. a first name or surname), and an e-mail address. Providing these data is voluntary but necessary to add a comment or review. You may also add your avatar (which may contain your image, e.g. a photo) and provide your website address, but this is not mandatory.
The data provided in connection with adding a comment or review will be processed in order to publish the comment or review on the website. The basis for processing is your consent (Article 6(1)(a) GDPR) resulting from submitting the form used to publish the comment or review. You can withdraw your consent at any time by requesting the deletion of the comment or review.
Your comment or review will be publicly available on the website for as long as the website is available online, unless you request its deletion earlier. You can also modify the content of the comment at any time, as well as the data assigned to it identifying the person who added the comment or review.
Handling correspondence – details
When contacting us, you naturally provide us with the personal data contained in your correspondence, in particular your e-mail address and your first name and surname. Providing the data is voluntary but necessary to make contact.
In this case, your data are processed in order to communicate with you, and the basis for processing is Article 6(1)(f) GDPR, i.e. our legitimate interest. The legal basis for processing after the contact has ended is also our legitimate purpose of archiving correspondence in order to be able to demonstrate certain facts in the future (Article 6(1)(f) GDPR).
The content of correspondence may be archived and we are unable to state definitively when it will be deleted. You have the right to request a copy of the history of your correspondence with us (if it has been archived) and to request its deletion, unless its archiving is justified by our overriding interests, e.g. defence against potential claims on your part.
Tax and accounting obligations – details
If we issue an invoice to you, it forms part of the accounting records, which will be kept for the period required by law. In such a case, your personal data are processed in order to fulfil our tax and accounting obligations (Article 6(1)(c) GDPR in conjunction with the provisions governing tax and accounting obligations).
Archive – details
In the descriptions of the individual processing purposes above, we have indicated the periods for which personal data are stored. These periods are often related to our archiving of certain data in order to be able to demonstrate certain facts in the future, reconstruct the course of cooperation with a customer or the correspondence exchanged, and defend, establish or pursue claims. In this respect, we rely on our legitimate interest referred to in Article 6(1)(f) GDPR.
Marketing of our own products – details
Our website uses an abandoned basket recovery mechanism. If you start the ordering process but do not complete it, our system will record this in order to take steps to encourage you to finalise the order. These steps may include, in particular, sending you an e-mail encouraging you to finalise the order or displaying targeted advertising while you browse the Internet.
Our website may also collect information about your activity and, on that basis, display targeted advertising to you while you browse the Internet. However, if you are not a registered user, the information used for this purpose does not constitute personal data. It only becomes personal data once it is combined with your personal data collected in your user account.
We carry out the activities described above on the basis of our legitimate interest referred to in Article 6(1)(f) GDPR, consisting in marketing our own products.
Analysis, statistics, optimisation – details
We collect statistical information about user behaviour while browsing our websites, such as clicks on links, navigation between subpages, time spent on individual pages, etc. We analyse this information in order to optimise our websites in terms of user experience, effectiveness and conversion. In most cases, information processed in this way does not constitute personal data. The exception is when you are a registered user. In that case, we may combine this information with other data about you collected in your user account.
We carry out the activities described above on the basis of our legitimate interest referred to in Article 6(1)(f) GDPR, consisting in optimising our websites.
# 7: How long will we store your personal data?
Data retention periods have been specified separately for each processing purpose. You will find this information in the details devoted to each individual processing purpose.
# 8: Who are the recipients of your personal data?
We venture to say that modern business cannot do without services provided by third parties. We use such services too. Some of these services involve the processing of your personal data. The external service providers involved in processing your personal data are:
- the hosting provider, which stores data on its server,
- the cloud computing service provider, in whose cloud backups that may contain your personal data are stored,
- the mailing system provider, in whose system your data are stored if you are a newsletter subscriber,
- the CRM system provider, in whose system we store your data in order to streamline customer service and for archival purposes,
- the invoicing system provider, in whose system your data are stored in order to issue an invoice,
- the accounting firm, which processes your data shown on invoices,
- courier companies, which process your data to the extent necessary to deliver your order,
- the law firm, which gains access to data where necessary to provide legal assistance to us,
- the technical support provider, which gains access to data if the technical work concerns areas containing personal data,
- other subcontractors, who gain access to data if the scope of their activities requires such access.
Your personal data may also be transferred to tax offices to the extent necessary to fulfil tax, settlement and accounting obligations. This applies in particular to all declarations, reports, statements and other accounting documents containing your personal data.
In addition, if necessary, your personal data may be disclosed to entities, authorities or institutions entitled to access data under the law, such as the police, security services, courts and public prosecutors’ offices.
Moreover, we use tools that collect a range of information about you related to your use of our website. This includes, in particular, the following information:
- information about the operating system and web browser you use,
- pages viewed,
- time spent on the website,
- navigation between individual subpages,
- clicks on individual links,
- the source from which you came to our website,
- your age range,
- your gender,
- your approximate location limited to the town or city.
- your interests determined on the basis of your online activity.
In our assessment, this information does not in itself constitute personal data. Because this information is collected by external tools we use, it is also processed by the tool providers in accordance with their terms of service and privacy policies. In principle, this information is used to provide and improve services, manage them, develop new services, measure the effectiveness of advertising, protect against fraud and abuse, and personalise content and advertising displayed on individual services, websites and applications. We have tried to describe the details later in this policy, in the explanations devoted to the individual tools.
# 9: Do we transfer your data to third countries or international organisations?
No, I do not transfer your personal data to third countries.
I would like to remind you, however, that I use external tools that may collect Anonymous Information. I have mentioned this several times in this policy, including in the answer to the previous question. The providers of these tools often use servers located all over the world, in particular in the United States of America (USA), to store the information collected.
# 10: Do we use profiling? Do we make automated decisions based on your personal data?
We do not make decisions about you based solely on automated processing, including profiling, that would produce legal effects concerning you or similarly significantly affect you.
We do use tools that may take certain actions depending on the information collected through tracking mechanisms, but we believe that these actions do not significantly affect you, as they do not differentiate your situation as a customer, do not affect the terms of the contract you may conclude with us, etc.
Using certain tools, we may, for example, show you personalised advertising based on your previous actions on our website or suggest products that may interest you. This is known as behavioural advertising. We encourage you to learn more about behavioural advertising, in particular with regard to privacy issues. Detailed information, together with the option to manage your behavioural advertising settings, can be found here: https://www.youronlinechoices.com.
We emphasise that, within the tools we use, we do not have access to information that would allow you to be identified. The information we are referring to here includes, in particular:
- information about the operating system and web browser you use,
- pages viewed,
- time spent on the website,
- navigation between individual subpages,
- the source from which you came to our website,
- your age range,
- your gender,
- your approximate location limited to the town or city,
- your interests determined on the basis of your online activity.
We do not combine the information listed above with your personal data held in our databases. This information is anonymous and does not allow us to identify you. It is stored on the servers of the providers of the individual tools, and these servers may be located anywhere in the world.
# 11: What rights do you have in connection with the processing of your personal data?
The GDPR grants you the following potential rights related to the processing of your personal data:
- the right of access to your data and to obtain a copy of it,
- the right to rectification (correction) of your data,
- the right to erasure of your data (if you believe there are no grounds for us to process your data, you may request that we erase it),
- the right to restriction of processing (you may request that we restrict the processing of your data to storage only or to activities agreed with you, if you believe that the data we hold are inaccurate or that we are processing them without a legal basis),
- the right to object to the processing of your data (you have the right to object to processing based on legitimate interest; you should indicate a particular situation which, in your opinion, justifies our ceasing the processing to which you object; we will stop processing your data for these purposes unless we demonstrate that our grounds for processing override your rights or that your data are necessary for us to establish, pursue or defend claims),
- the right to data portability (you have the right to receive from us, in a structured, commonly used and machine-readable format, the personal data you have provided to us on the basis of a contract or your consent; you may instruct us to transmit this data directly to another entity),
- the right to withdraw consent to the processing of personal data, if you have previously given such consent,
- the right to lodge a complaint with a supervisory authority (if you find that we are processing data unlawfully, you may lodge a complaint with the President of the Personal Data Protection Office or another competent supervisory authority).
The rules for exercising the rights listed above are described in detail in Articles 16-21 GDPR. We encourage you to read these provisions. For our part, we consider it necessary to explain that the rights listed above are not absolute and will not apply to all processing operations involving your personal data.
We emphasise that one of the rights listed above is always available to you – if you consider that we have infringed data protection regulations when processing your personal data, you can lodge a complaint with the supervisory authority (the President of the Personal Data Protection Office).
You can also always ask us to provide you with information about what data we hold about you and for what purposes we process it. Simply send a message to RODO@jakubjacek.pro. However, we have made every effort to ensure that the information of interest to you is presented comprehensively in this Privacy Policy. You can also use the e-mail address above if you have any questions relating to the processing of your personal data.
# 12: Do we use cookies and what exactly are they?
Our website, like almost all other websites, uses cookies.
Cookies are small pieces of text information stored on your terminal device (e.g. computer, tablet, smartphone) that can be read by our ICT system (first-party cookies) or by the ICT systems of third parties (third-party cookies). Certain information may be recorded and stored in cookies, which ICT systems may then access for specific purposes.
Some cookies we use are deleted at the end of the browser session, i.e. when you close the browser (so-called session cookies). Other cookies are retained on your terminal device and allow us to recognise your browser the next time you visit the website (persistent cookies).
If you would like to learn more about cookies as such, you can read, for example, this material: https://en.wikipedia.org/wiki/HTTP_cookie.
# 13: On what basis do we use cookies?
We use cookies on the basis of your consent, except where cookies are necessary for the proper provision of an electronic service to you.
As regards your consent to cookies, we adopt the approach whereby you give such consent through the settings of your web browser or additional software supporting cookie management. We assume that you consent to all cookies we use that are not blocked by your browser or the additional software you use.
Please remember that disabling or restricting cookies may prevent you from using some of the features available on our website and cause difficulties in using our website, as well as many other websites that use cookies. For example, if you block cookies from social media plugins, the buttons, widgets and social features implemented on our website may be unavailable to you.
# 14: Can you disable cookies?
Yes, you can manage cookie settings in your web browser. You can block all or selected cookies. You can also block cookies from specific websites. You can also delete previously stored cookies and other site and plugin data at any time.
Web browsers also offer the option of using incognito mode. You can use it if you do not want information about the pages you visit and the files you download to be saved in your browsing and download history. Cookies created in incognito mode are deleted when all incognito windows are closed.
There are also browser plugins that allow you to control cookies, such as Ghostery (https://www.ghostery.com). Control over cookies may also be provided by additional software, in particular antivirus suites, etc.
In addition, tools are available online that allow you to control certain types of cookies, in particular to manage behavioural advertising settings collectively (e.g. www.youronlinechoices.com/, thenai.org/how-to-opt-out/).
# 15: For what purposes do we use first-party cookies?
First-party cookies are used to ensure the proper functioning of individual website mechanisms, such as maintaining the session after logging in to your account and remembering recently viewed products and products added to the basket.
First-party cookies also store information about the cookie settings you have defined using the cookie management mechanism.
First-party cookies are also used to operate the abandoned basket recovery mechanism.
# 16: Which third-party cookies are used?
The following third-party cookies are used on our website:
- Google Analytics,
- Google Tag Manager,
- Google Ads,
- Google AdSense,
- Meta Custom Audiences,
- Facebook, X, LinkedIn, Pinterest (social media tool cookies),
- Disqus,
- Hotjar,
- SoundCloud,
- YouTube.
Details of the individual third-party cookies are described below.
Google Analytics – details
We use Google Analytics 4, an analytics tool provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. We do so on the basis of your consent given in the cookie banner (Article 6(1)(a) GDPR), in order to create and analyse statistics so that we can improve our website.
Our website uses Google Consent Mode. Until you consent to analytics cookies, Google Analytics does not store cookies on your device and receives only anonymous signals without identifiers. You can change or withdraw your consent at any time in “Cookie Settings” in the website footer. You can also block the Google Analytics code with a browser add-on: https://tools.google.com/dlpage/gaoptout.
Google Analytics 4 does not log or store IP addresses. The IP address is used only to determine the approximate location (country, region, city) and is discarded immediately; for users in the European Union, this takes place on servers in the EU.
The information we have access to through Google Analytics includes, in particular:
- information about the operating system and web browser you use,
- the subpages you view on our website,
- time spent on our website and its subpages,
- navigation between individual subpages,
- the source from which you came to our website.
If you consent to advertising cookies, we also use Google signals, i.e. data from users signed in to their Google accounts who have turned on ad personalisation. This allows us to see aggregated demographics and interests reports (age range, gender, interests) and to create remarketing audience lists in Google Ads. This data is aggregated and does not allow us to identify you.
We keep data in Google Analytics for no longer than 14 months.
Data may be transferred to Google LLC in the United States. Google LLC participates in the EU-U.S. Data Privacy Framework, under which the European Commission has decided that it ensures an adequate level of data protection.
Google Analytics and Google Analytics 360 have been certified under the independent ISO 27001 security standard. ISO 27001 is one of the most widely recognised standards in the world and certifies that the systems supporting Google Analytics and Google Analytics 360 meet the relevant requirements.
If you are interested in the details of how Google uses data from websites and apps that use Google services, we encourage you to read this information: https://policies.google.com/technologies/partner-sites.
Google Tag Manager – details
We use Google Tag Manager, provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, which allows us to manage tags, i.e. small pieces of code that enable us to
monitor user traffic and behaviour, collect information about the effectiveness of advertising and
take steps to improve our website. Google Tag Manager
does not collect any information that would allow you to be identified; however, the tool triggers other tags, which in turn may collect data.
Google Ads – details
We use the remarketing features available in the Google Ads system operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. We do so on the basis of our legitimate interest, consisting in marketing our own products or services.
When you visit our website, a Google remarketing cookie is automatically placed on your device, which collects information about your activity on our website. Thanks to the information collected in this way, we are able to show you advertisements in the Google network depending on your behaviour on our website. For example, if you view a product, this will be recorded by the remarketing cookie, which will allow us to show you an advertisement for that product or any other advertisement we consider appropriate. This advertisement will be shown to you in the Google network while you use the Internet, browse other websites, etc.
We emphasise that, when using Google Ads, we do not collect any data that would allow you to be identified. Any combination of data in a way that makes it personal data may take place on Google’s side, but we are not responsible for this, as Google carries out these activities on the basis of an agreement concluded with you as a user of Google services.
When using Google Ads, we are only able to define the audiences we would like our advertisements to reach. On this basis, Google decides when and how to show you our advertisement.
Further processing of information only takes place if you have consented to Google linking your browsing history to your account and using information from your Google account to personalise the advertisements displayed on websites. In such a case, Google will use your data to create and define target audience lists for cross-device remarketing. For this purpose, Google temporarily combines the information collected with other data it holds in order to create target groups.
If you do not want to receive personalised advertisements, you can manage your ad settings directly with Google: https://adssettings.google.com/.
If you are interested in the details of how Google uses data from websites and apps that use Google services, we encourage you to read this information: https://policies.google.com/technologies/partner-sites.
Google AdSense – details
We display advertisements on our websites within the Google AdSense network operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. We do so on the basis of our legitimate interest, consisting in monetising the content we publish.
Because it displays advertisements within the AdSense network, our website contains ad tags that instruct your web browser to request advertising content from Google servers. Together with the advertising content, the server also sends a cookie. Cookies are used to display advertisements based on your previous visits to our website or other websites. AdSense also uses cookies to improve the quality of advertisements. Common uses include targeting advertisements based on topics that interest you, improving campaign performance reports and avoiding showing you advertisements you have already seen.
We emphasise that, when using Google AdSense, we do not collect any data that would allow you to be identified. Any combination of data in a way that makes it personal data may take place on Google’s side, but we are not responsible for this, as Google carries out these activities on the basis of an agreement concluded with you as a user of Google services.
Meta Custom Audiences – details
Within the Meta Ads advertising system provided by Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland, we use the Custom Audiences feature to target advertising messages at specific groups of users. We do so on the basis of our legitimate interest, consisting in marketing our own products or services.
In order to show you advertisements personalised according to your behaviour on our website, we have implemented the Meta Pixel on our website, which automatically collects information about your use of our website. The information collected in this way is usually transferred to Facebook servers, which may be located anywhere in the world, in particular in the United States of America (USA).
The information collected through the Meta Pixel is anonymous, i.e. it does not allow us to identify you. Depending on your activity on our websites, you may be included in a specific audience, but we do not identify the individual people belonging to these audiences in any way.
We would like to inform you, however, that Facebook may combine the information collected with other information about you collected through your use of Facebook and use it for its own purposes, including marketing. Such activities of Facebook do not depend on us, and you can find information about them directly in Facebook’s privacy policy: https://www.facebook.com/privacy/explanation. You can also manage your privacy settings from your Facebook account. Here you will find useful information on this: https://www.facebook.com/ads/settings.
Social media tools – details
Our website uses plugins, buttons and other social media tools, hereinafter collectively referred to as “plugins”, provided by social networks such as Facebook, Instagram, LinkedIn, X and Pinterest.
When you view a page of our website containing a plugin of a given social network, your browser sends information about the visit to the operator of that social network. Because the plugin is a part of the social network embedded in our website, the browser sends information about the request to load the content of that social network into our website.
Plugins collect certain information about you, such as your user ID, the website visited, the date and time, and other information relating to your web browser.
Social network operators use some of this information to personalise the way you view our website. For example, when you visit a page with a “Like” button, the social network operator needs to know who you are in order to show you which of your friends also like our website.
Information collected by plugins may also be used by social network operators for their own purposes, such as improving their own products, creating user profiles, analysing and optimising their own activities and targeting advertising. We have no real influence on how the information collected by plugins is subsequently used by social network operators. You can find details on this in the terms of service and privacy policies of the individual social networks.
Social media plugins collect and transmit information to the operators of these services even when you browse our website without being logged in to your social media account. In that case, however, the browser sends a more limited set of information.
If you are logged in to one of the social networks, the operator of that service will be able to directly assign your visit to our website to your profile on that social network.
If you do not want social networks to assign data collected during your visit to our website directly to your profile on that service, you must log out of that service before visiting our website. You can also completely prevent plugins from loading on the website by using appropriate extensions for your browser, e.g. script blocking.
In addition, using some plugins may involve publishing certain information on your social media profiles. For example, information about clicks on the “Like” button may be visible on your Facebook timeline. Of course, if you share any content on your social media using the plugins embedded on our website, that sharing will naturally be visible on your profile.
As regards the details of the processing by social network operators of information collected by plugins, in particular the purpose and scope of data collection and its further processing and use by the operators, as well as contact options, your rights in this respect and the settings available to protect your privacy, you will find everything in the privacy policies of the individual service providers:

Our website uses the Disqus comment system operated by an external entity, i.e. Disqus, Inc., 717 Market St San Francisco, CA 94103, USA.
When you view a page containing comments operated by the Disqus system, Disqus sends one or more cookies to your device that identify your web browser. Disqus cookies are responsible for the proper functioning of the comment system and in particular make logging in easier. Disqus cookies also collect information about how you use our website (e.g. the subpages you visit, the links you click) in order to analyse your activity and personalise the content, including advertisements, displayed to you within the Disqus system.
If Disqus displays advertisements, it uses technologies supporting this process, such as Google, Polymorph and ServeBid, which may set cookies for the purposes of marketing personalisation, linking advertisements to subsequent activities and limiting how often individual advertisements are shown to you.
Please remember that you use the Disqus comment system as its own user, on the basis of the Disqus terms of service and privacy policy. Disqus is an independent entity, separate from us, that provides electronic services to you. You can find details of the rules for using the Disqus system, including privacy protection, in the documents made available directly by Disqus:
